Terms of Business

Thank you for considering the services of Maria Whiting and our team. Please read through all terms and conditions so that you are fully aware of your, and our obligations and rights. 

1.     Booking deposit

A non-refundable and non-transferable deposit of 20% of our total fee is required to secure any booking. The deposit can be made via internet banking, PayPal or revolut (details to be provided by us). The deposit is taken off your total fee. Upon confirmation by us of the booking, you are agreeing to these terms and conditions which will then become the agreement between us unless otherwise terminated in accordance with these terms and conditions.  

2.     Travel Expenses

You (as our client), will cover any necessary travel expenses of our makeup and/or hair artist(s) as agreed at the time of booking. This is to include, should it be required, congestion charging, parking and toll charges. 

Mileage outside a 5k radius is charged at a rate of €0.52 per kilometre.  Charges may be applied for unsociable hours such as public/bank holiday /early morning (prior to 7am)/evenings (after 6pm) & Sundays.

Where necessary, we may agree on accommodation and flights used by us which are payable by you in relation to your appointment.

3.     Fees and Payment 

Our fees are as set out as per our quote provided.

Payments can be made in cash, or via internet banking/PayPal or revolut (as agreed between us). Cheques will not be accepted.

The non-refundable and non-transferable booking fee (mentioned above) is deducted from the total fee.

Agreed fees for your booking must be paid prior to or on the date of your appointment unless otherwise agreed between us. Failure to pay the remainder of the fee within the agreed timeframe can result in the appointment being cancelled by us unless otherwise agreed between us.

In the unlikely event that the makeup and/or hair artist is unable to attend the appointment *due to (but not limited to) sickness, accident, injury or personal emergency, a make-up/and or hair artist (as applicable) will be sourced to complete the booking. If we are unable to find a suitable replacement, a full refund will be issued minus the trial amount.

If the booking is directly affected by circumstances beyond our control, where possible we will always endeavour to rectify such situations. However, no compensation will be offered on our part. It is strongly advised you take out insurance to cover you against these situations.

4.     Trials

If we deem a trial necessary, then a trial is arranged for a mutually convenient date and time. The trial duration is up to 1 hour 30 mins per service. If a trial exceeds this time per service, a 2nd trial may be arranged at additional charge.

Trial appointments are subject to change in the event of illness or incapacity to work by either of us.

5.  Photographs

On the day of the trial, the look may be documented in a photograph (that will not be disclosed online prior to your appointment) and notes made of the products and shades.

6.     Cancellations

We reserve the right to cancel a booking following a trial within 24 hours of the trial with full refund of the deposit minus payment for the trial if it transpires that the relationship is not conducive for a relaxed day(s) of service by us.

You may cancel your booking with us but for non-wedding type bookings cancelled by you up to 48hrs prior to your appointment, 50% of the total payment is due and payable by you. For such bookings cancelled within 48hrs prior to your appointment, full payment is due and payable by you. 

For wedding bookings cancelled up to 60 days prior to your wedding date, 50% of the total payment is due and payable by you. For wedding bookings cancelled by you within 60 days prior to your wedding date, the total payment is due and payable by you.

Cancellations by us due to circumstances including (but not limited to) problems rendering the performance of our obligations unachievable and where no other suitable alternative can be given will result in a refund to you, minus the initial deposit. No further compensation will be offered.

If the booking is directly affected by circumstances beyond our control, every possible endeavour to rectify such situations will be made, however no compensation will be offered on our part. You are strongly advised to take out insurance to cover against such situations.  

7.     Health and Safety

Every effort is made by us to ensure the highest level of cleanliness and sanitisation of all makeup & hair tools, products & equipment used by us.

You must ensure that we are notified of any allergies, medical issues or sensitivities prior to application by you or any of your party (as the case may be). If unnotified, then we are not responsible for any adverse consequences as a result of you or your party’s failure to make such notification.   

Please advise us if you and/or your party have any contagious illness or diseases such as Covid19, conjunctivitis, herpes, skin rashes, styes etc

We maintain the right to refuse you or any of your party where contraindications exist.

We cannot be held liable for any losses incurred due to you and/or your party’s failure to inform us of any known or unknown condition.

We reserve the right to refuse service without refund to you and/or your party for (but not limited to) abusive, violent or threatening behaviour.

If we suspect the products to be unsuitable for a specific skin condition, based on information given from you and/or your party, we may refuse the service.

For health and safety reasons, you and/or your party are asked not to smoke during the service provided.

For your safety during makeup application, please do not eat or use your mobile phone during make up.

It is recommended to apply contact lenses prior to makeup. 

8.     GDPR

We each agree to be in full compliance with each of our respective obligations under the General Data Protection Regulation, (GDPR) (EU) 2016/679. If applicable, we will notify each other in a timely manner if there is a data breach that involves the other person’s personal data.

9. Photographs

Unless you state otherwise at the time of appointment, you agree that we may take photographs of the completed look on the day(s) of the appointment which may be used for publicity purposes which include (but are not limited to) our website and associated social media sites. Any objections should be made in writing to info@mwmakeup.ie.

10. Insurance 

We have all the requisite insurances in place up to the value of  €2,600,00.00

11. Liability

We, MW Makeup Ltd is not liable for any allergic reactions/illnesses caused as a result of our service.

Furthermore, MW Makeup Ltd is not liable for any damage to your home, event venue (as the case may be) or personal belongings.

We are not liable for any of the supplier and/or manufacturer brands we recommend. If a product is defective in any way and for any reason including but not limited to not being packaged correctly or having expired by or through the supplier/manufacturer, we shall not be associated with this issue and will not be held liable.

We shall not be liable to you and/or your party, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the services provided for loss of damage to goodwill and any indirect or consequential monetary, physical or psychological loss.

12. Confidentiality.

Neither party shall use the other party’s confidential information for any purpose other than to perform its obligations relating to the booking and appointment.

13. Variation

These terms and conditions may be varied by us from time to time. Such revised terms will apply from the date of publication on our website at www.mwmakeup.ie.

Users should check the terms and conditions regularly to ensure familiarity with the then current version.
